  1. State who the maker is, what state they are a resident of, that he or she is of sound mind and state the date the Will is made.
  2. Revoke all prior Wills and Codicils.
  3. Direct that all just debts be paid.
  4. List the names of your primary beneficiaries and their relationship to you.
  5. State who your estate goes to and what part or share each beneficiary receives upon your death.
  6. State who your estate goes to if any of your primary beneficiaries dies before you do.
  7. State who your estate goes to if all of your primary beneficiaries die before you do or with you in a single accident or common disaster.
  8. State how long someone has to survive you to get their inheritance.
  9. Appoint a personal representative and at least one alternate to pay your bills and collect your estate assets and distribute them.
  10. Waive a bond for your personal representative.
  11. Contain a provision for the use of a Tangible Personal Property Memorandum to leave specific items of personal property to someone other than real estate and cash.
  12. Contain a provision for you to set the age at which a minor beneficiary receives his or her inheritance.
  13. Contain a provision appointing a trustee to hold the minor’s inheritance in trust until the minor attains the age you specify.
  14. Allow this trustee to use the child’s inheritance for that child’s health, education and welfare.
  15. Contain a provision that says any person or organization that is not included in your Will is not due to oversight or neglect, but because they are not to share in your estate.
  16. Contain a provision to appoint a guardian and alternate guardian if you have minor children.
  17. Contain a section that allows you to leave cash bequests or leave other instructions on specific things to do after your death.
  18. Contain a section on what to do with your remains.
  19. Contain an affidavit page signed by you and the witnesses that is notarized.
  20. Are easy to read and understand so that you actually know what it says.
